1 Introduction
At Designa (Designa Australia Pty Ltd (ACN 160 442 062), we and our Affiliates are committed to the privacy and security of any personally identifiable information provided to us by our users. Personally identifiable information is any information that can be linked to a specific individual (eg. name, phone numbers, email).
This privacy policy explains how we and our Affiliates handle and protect your personally identifiable information. We do this in accordance with the Privacy Act 1988 (Cth) (Act).
We reserve the right to modify or amend this policy at any time and for any reason. Any material changes to this privacy policy will be posted prior to their implementation.

2 What information do we collect?
2.1 Client / End user
If you are an individual Client (including an End User) using the Website’s” https://designaparkinghqeast.com.au , https://designaparkinghqwest.com.au , https://parkingclaremont.com.au or the Parking HQ Application (App), then at or before the use of our services we may record your: (a) name;
(b) contact details such as street and/or postal address and relevant telephone numbers;
(c) date and place of birth;
(d) account number and other account information;
(e) user name, password, PIN, and answers to security questions;
(f) all and any data you input into the Website or App including license plate data and vehicle specification data;
(g) credit card or banking information;
(h) all logs, which may include information such as your internet protocol (IP) address, browser type, browser version, clickstream data, referring URLs, the pages of our Website that you visit, the time spent on any pages of our Website or App and other log related information relating to your use of our Website or App;
(i) purchase history;
(j) your schedule in respect to use of the services purchased via the Website or App;
(k) your user credentials;
(l) other information you provide to us directly, such as information collected for identification purposes.
We will collect and record any other information you provide to us while using our services.
To the extent permitted by law, we may collect additional Personal Information where such information is necessary for one or more of our functions and activities, such as:
(m) financial information and transaction details;
(n) information about your identity including residency, citizenship, and identification documentation for the purpose of complying with regulatory requirements;
(o) details of goods and services provided to you;
(p) other information that you provide to us in connection with the functions of the Website or App.
2.2 Affiliate
If you are an individual associated with an Affiliate engaged by us to provide services to Clients, we will record your:
(a) name;
(b) company information;
(c) email address;
(d) mobile number; and
(e) any other information required to enter into an arrangement with you as an Affiliate.
To the extent permitted by law, we may collect additional Personal Information where such information is necessary for one or more of our functions and activities, such as:
(f) financial information and transaction details;
(g) information about your identity including residency, citizenship, and identification documentation for the purpose of complying with regulatory requirements;
(h) details of goods and services provided to you;
(i) other information that you provide to us in connection with the functions of the Website or App. If you do not provide us with personal information we request or require, we may not be able to provide certain (or any) services to you nor allow you to take part in provision of any such services.
3 How do we collect your personal information?
3.1 Cookies
We may collect personal information from you whenever you input such information into the Website or App.
We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

(c) administering and managing the products and services provided to you;

(f) to liaise with owners and customers associated with the services;
(g) develop and/or test our systems and services;
(h) administer contracts into which we may enter with you;
(i) compliance with legal obligations.

5 How do we store your personal information?
5.1 Technical matters
Designa stores any data used online on an Australian Signals Directorate (ASD) certified cloud service provider (Amazon Web Services or Microsoft Azure) and uses Secure Sockets Layer (SSL) protocols to provide users secure and private access to the Service. You agree and acknowledge:
(a) to your information being stored in this location and accessed in this way and otherwise dealt with in accordance with these Terms;
(b) that we will take steps to ensure that User Information is kept secure and confidential;
(c) we may use any information stored for secondary purposes including marketing, reporting, training and improvement of all or any part of the Service; and
(d) use of Amazon Web Services or Microsoft Azure as a third party hosting service is provided without any sort of warranties, and Designa cannot ensure that these third party hosting services are provided free of defect or without interruption.
6 Direct Marketing We may use your Personal Information for the purposes of directly marketing our products and services to you. We may also provide your information to third party providers of goods and services to enable them to market and advertise to you through our Website or App.
By using the Website and Application, you consent to the collection and use of your personal information for direct marketing purposes.
If you do not wish to receive direct marketing communications from us, you can opt-out of receiving such communications by emailing us at sales_au@designa.com or unsubscribing in the communications that you have received from us.
7 With whom do we share your information?
Other than as set out above, we do not disclose information to anyone except the relevant Affiliate and Client, as well as any of our staff and contractors who need that information in order to provide or facilitate the provision of our services to you.
We may be required by law to disclose information you provide us with for the purposes of obtaining products or services, in which case we only disclose information to the extent we are required to disclose it and only to those to whom we are required to disclose it, or if necessary to our legal advisors for the purposes of obtaining legal advice. We may also disclose information about someone whose activities could cause harm to others (for example, fraud).
Other than in the circumstances outlined above or as otherwise specifically permitted under the Act, the information you supply to us remains stored confidentially on our secure servers and is not shared with third parties.

9 Accessing and correcting your personal information
Under the Act, you have the right to ask for access to personal information that we hold about you, and ask that we correct that personal information.
You can ask for access or correction by contacting us and we must respond within 30 days. If you ask, we must give you access to your personal information, and take reasonable steps to correct it if we consider it is incorrect, unless there is a law that allows or requires us not to.
We will ask you to verify your identity before we give you access to your information or correct it, and we will try to make the process as simple as possible. If we refuse to give you access to, or correct, your personal information, we must notify you in writing setting out the reasons.
If we make a correction and we have disclosed the incorrect information to others, you can ask us to tell them about the correction. We must do so unless there is a valid reason not to.
If we refuse to correct your personal information, you can ask us to associate with it (for example, attach or link) a statement that you believe the information is incorrect and why.
We will not impose a fee upon you for making a request for access to your information. However, we may impose a charge upon you to recover any reasonable cost we incur in preparing, releasing and giving access to the requested personal information. 10 Data breaches
If we suspect that a data breach has occurred, we will undertake an assessment of the circumstances of the suspected breach within 30 days after the suspected breach has occurred. Where it is ascertained that a breach has actually occurred and where required by law, we will notify the Privacy Commissioner and affected customers as soon as practicable after becoming aware that a data breach has occurred.
11 How to make a complaint
If you wish to complain to us about how we have handled your personal information you should complain in writing. If you need help lodging a complaint, you can contact us.
If we receive a complaint from you about how we have handled your personal information we will determine what (if any) action we should take to resolve the complaint.
We will tell you promptly that we have received your complaint and then respond to the complaint within 30 days.
If you are not satisfied with our response you can contact the Office of the Australian Information Commissioner.
12 How do we protect your information?
To ensure the confidentiality of your personally identifiable information, we use industry standard security technology and procedures.
Information stored in our computer database is protected by firewalls and password access are limited to designated personnel.
When your personal information is no longer necessary for the purpose it was provided, we will take steps to destroy or de-identify the information.
We will retain your information for any specified period under an Australian law or court/tribunal order.
When you send personally identifiable information to us over the Internet, your data is protected by state of the art Secure Socket Layer (SSL) technology. This is the same technology used to secure Internet Banking transactions.
